Italy's Escort Market, City by City: How a 1958 Law Still Draws the Map

That single arrangement explains more about the shape of the Italian market than any account of Italian culture does. It is why the country has no meaningful agency sector, why the market runs on self-managed classified listings, and why the geography shifts every summer in response to municipal orders that expire and get reissued.

The law is Legge Merlin, passed in 1958 and still in force. What follows is what it criminalises, how the courts have drawn its edges, and what the resulting map looks like.

What the Merlin Law did, and did not, make criminal

Law 75 of 20 February 1958 carries a title that states its purpose: the abolition of the regulation of prostitution and the fight against the exploitation of the prostitution of others.

It abolished a system. When the law took effect on 20 September 1958, 560 state-licensed houses closed, with roughly 2,700 registered women affected. Article 7 went further. It barred every public security, health and administrative authority from keeping any register of women who sell sex or are suspected of doing so.

Article 3 sets out eight offences, each punishable by two to six years and a fine. Every one targets a third party: owning or running a house of prostitution, letting premises for that purpose, tolerating it on hotel or bar premises, recruiting, inducing, and facilitating or exploiting another person's prostitution.

Neither selling nor buying appears anywhere in the statute. The law is abolitionist rather than prohibitionist. It removed state regulation and criminalised the surrounding economy instead.

Facilitation is the offence that shapes everything

The eighth offence in Article 3 is the operative one. It catches anyone who "in any way" facilitates the prostitution of another person. The conduct element is undefined, so the boundary has been drawn case by case.

The Court of Cassation has held that habitually driving a woman by car to the place where she sells sex is criminal facilitation. Generic intent suffices, and motive is irrelevant. Driving a friend to an appointment can put you inside an offence carrying two to six years.

Renting a flat is different. The same court held in 2013 that letting an apartment at market rent, knowing the tenant will work there, is not an offence. The market-rate qualifier does the work. It is rent above the market rate that risks turning a landlord into someone taking a share.

Cohabitation also falls outside the offence. In a ruling deposited in December 2025, the court held that merely sharing a roof or a bed with someone who sells sex is not facilitation. It required genuine intermediary activity between supply and demand.

Read those together and a pattern appears. Almost every arrangement that would let people work together safely sits close to a criminal line.

The online boundary sits between hosting and editing

Two rulings define how the Italian market advertises, and the gap between them is narrow.

In November 2014 the Court of Cassation held that collecting and publishing paid advertisements for sexual services is not criminal facilitation. The court called it the mere collection and publication of advertising insertions, disconnected from the activity itself. The offence requires conduct directed at procuring clients.

A 2024 ruling drew the other edge. Selecting which photographs to feature, taking new ones, rewriting advert copy and coordinating promotion crosses into exploitation. The test was whether the collaboration made the offer more accessible and eased contact with clients.

Hosting a listing can be lawful where editing it is not, and which side any conduct falls on turns on whether it facilitates or exploits. That distinction, more than any commercial preference, is why Italy has almost no agency layer and why an Italian escort directory carries listings that the people named on them write, price and control themselves.

Both constitutional challenges have failed

The Merlin Law has been tested twice at the highest level and has survived twice.

In 2019 the Court of Appeal of Bari referred the recruitment and facilitation offences to the Constitutional Court, arguing they should not apply to prostitution voluntarily exercised. The Court rejected every question. Its reasoning was that the line between a free choice and a constrained one is fluid in theory and hard to verify afterwards in criminal proceedings.

The second challenge came from the Tribunal of Bologna in December 2024 and attacked the penalty rather than the offence. The Constitutional Court filed its rejection in March 2026. As of this year, the offence and its sentencing range both stand.

Cities draw the map street by street

Municipal orders are the second layer, and a 2011 constitutional ruling explains their odd rhythm.

That decision struck down mayors' ordinary powers to issue urban security orders, on the basis that identical behaviour could be treated differently town by town without a unified legislative footing. Since then, anti-prostitution orders have had to be contingent and urgent, meaning temporary emergency measures. That is a large part of why they are reissued each season with fixed expiry dates rather than sitting permanently on the books.

The resulting instruments are strikingly specific:

• Venice and Mestre named 117 streets, with fines of €100 to €400 applied to clients.
• Perugia issued order 1406 on 11 June 2024, covering fourteen named streets and car parks, with a €450 fine. It penalises the simple act of stopping in order to negotiate.
• Rimini covers around fifty streets including Viale Regina Elena and the SS16, at €500 reduced to €400 if paid within sixty days. Drivers face €42, rising to €56 between 22:00 and 07:00.
• Vicenza extended its 2025 order to activity inside cars, campers and caravans, at €500.
• Rome works through its 2019 urban police regulation, allowing a 48-hour removal order extendable to sixty days.

Academic work on these orders describes two paradigms, containment and exclusion, and finds they produce a geography in constant flux as enforcement pushes activity toward peripheral streets. Enforcement has also been asymmetric. A 2009 report covering 56 municipalities recorded roughly 1,000 fines issued to sex workers in Rome against 53 to clients.

Where the demand sits

No published research maps Italy's escort market city by city. What follows reasons from demand data, and it is worth saying so plainly rather than dressing inference as finding.

Milan runs on a business calendar. Salone del Mobile drew 316,342 attendees from 167 countries in 2026, 68 per cent of them foreign. Fashion Week in September 2025 brought over 149,300 visitors spending an average of €1,600 each.

Rome runs on volume instead, recording 22.9 million arrivals in 2025 and 52.92 million overnight stays. That is 9.4 per cent of all national arrivals. The northern industrial cities move differently again. Piedmont posted 6.73 million arrivals in 2025, up 7.1 per cent, against a national arrivals figure that ISTAT recorded as down 0.9 per cent.

The south and the coast are seasonal. Naples passed 20 million visitors in 2025, sharply up year on year. That seasonal concentration is also where the summer municipal orders cluster, which is unlikely to be coincidence.

The state counts what it will not let anyone organise

Italy includes prostitution in its national accounts under the European statistical framework. In a report published in October 2025, the national statistics institute put its value added at €4.1 billion for 2023, up 2.8 per cent on the previous year.

The income is also taxable. In 2016 the tax division of the Court of Cassation held that earnings from prostitution generate taxable income regardless of the activity's legal position.

Counted in GDP, taxed as income, and most ways of organising it safely sit inside an offence carrying two to six years.

Final thoughts

The map of Italy's market is a legal artefact rather than a cultural one.

Facilitation liability removes the agency layer, so the market atomises into individuals. The hosting and editing distinction pushes advertising onto self-managed classifieds. Municipal orders redraw the street geography every season, and the constitutional requirement that they stay temporary is why the redrawing never stops.

Anyone reading the Italian market by comparing its cities is reading the wrong document. The relevant one passed in 1958.
